Torts Law Problem Case Study Example | Topics and Well Written Essays - 1250 words

Torts Law Problem - Case Study Example His actions could therefore be interpreted as being binding upon MoreeRE Company, and thus establishing liability on the company under the doctrine vicarious liability. In order to file suit under the tort of negligence successfully, Cathy has to prove that there was duty of care owed to her by MooreRE Company and because of a breach of this duty of care, she suffered loss and damage. In the English case of Donoghue vs. Stevenson,2 the duty of care was established as a fundamental requirement in any action for a tort of negligence. The court defined this duty as the fundamental duty of not undertaking an action where it is reasonably foreseeable that an act or omission would injure or bring about loss or damage to those whom it is reasonably foreseeable that an act or omission would injure or bring about loss and damage to those whom it is reasonably foreseeable that they would be affected by such an act or omission. Section 52 of the Australian Trade Practices Act 1974 provides that , â€Å"A company shall not, in trade or commerce, participate in conduct that is misrepresentative or deceptive, or is likely to mislead or deceive.† From this provision, it is arguable that MoreeRE owed Cathy a duty of care not to engage in any conduct or making of statements that could be deemed as misleading or deceptive with the aim of procuring advantage thereof. The representation made by John to Cathy was misleading and it is in the reliance of this representation that Cathy secured the sale of her house for $100,000 less than the actual market value. This can be interpreted as a direct violation of the duty of care owed to Cathy by MooreRE Corporation, and because of this, she suffered loss. It is thus arguable that MooreRE breached this duty of care once their agent made those false representations. Reliance on the representation resulting from the breach of the duty of care the corporation owed to Cathy led her to suffer loss and damage, hence completing the requir ements needed for a successful claim under the tort of negligence. It is thus obvious that Cathy’s loss can be attributed directly to the breach of this duty of care that was owed to her by MooreRE Corporation. Cathy could also succeed in a claim of the tort of negligence under the tort of misrepresentation. The cause of action could arise from either fraudulent misrepresentation or innocent misrepresentation. A misrepresentation occurs when person makes a statement, on whose reliance makes another person to act upon this statement, and as result of this reliance, the party suffers loss and damage. A misrepresentation could thus be either an innocent misrepresentation or a fraudulent misrepresentation. A representation is fraudulent if the party making such a representation makes it with the intention that a party will rely on it, and such reliance will be beneficial to him. A representation, on the other hand, amounts to an innocent misrepresentation where the party making t he statement is unaware of the consequences of such a representation, and the party relying on such a representation suffers loss and damage from such representation. In the scenario, John’s representation cannot be termed as a fraudulent misrepresentation as he did not have the fraudulent intention to defraud Cathy through the transaction. This is because he thought he was carrying out business for his company with the

Children’s Functional Health Pattern Essay Example for Free

Children’s Functional Health Pattern Essay Toddlers believe rules are absolute and behave out of fear of punishment. The toddler will respond with good behavior for positive feedback. These  values and beliefs are learned. Preschoolers frequently express their values by stating who or what they like or what they want to be when they grow up. Preschoolers receive modeling of values from involved adults, peers, as they develop their morality. School-Age children’s values come from religion, cultural, and parental values influences. These factors shape a child’s moral development, and concept of right and wrong. School-age children are able to make decisions related to moral and ethical issues. Parents may cater to their toddler when they are misbehaving, giving them more attention when they are bad than when they are good. This make the toddler believe that behaving badly gets their parents attention. Parents need to remember to reward good behavior, and to emphasize rewards for acceptable behavior and minimizing attention for unwanted behavior. Parents may not have firm and established rules, making it confusing for the toddler to distinguish right from wrong. Peers or inappropriate content on television can negatively influence preschooler’s values and beliefs. Parents may have a poor morals and value system themselves, inadvertently teaching their preschoolers the same behaviors. School-age children may bend to peer pressure to gain the acceptance of their peers. School-Age children may cheat due a desire to win, or pressure from their parents and peers to be great. Short Answer Questions Address the following based on the above assessment findings. Expected answers will be 1-2 paragraphs in length. Cite and reference outside sources used. 1) Compare and contrast identified similarities as well as differences in  expected assessment across the childhood age groups. Across the stages of development from toddler up to school age children there is a significant difference in the amount of guidance needed and the amount independence required. The differences are evident when examining how each developmental phase interacts and responds within each health assessment pattern. Toddler and preschool children need more structure and routine, whether it’s brushing their teeth or bedtime rituals. School-aged children, on the other hand, require more independence and trust in decisions while still being guided and reassured as the develop their own sense of identity. There are similarities as amongst the age groups as well, such as all of the children moving towards a state of autonomy and the ability to express themselves adequately and be heard by either their parents, their peers, or both. Additionally, all of the different age groups have the need for a structured and healthy home environment in order to grow and develop. 2) Summarize how a nurse would handle physical assessments, examinations, education, and communication differently with children versus adults. Consider spirituality and cultural differences in your answer. When the nurse is caring for a child, the nurse must remember that they are essentially caring for the child and the parent (Jarvis, 2012). For a nurse, the assessment, examination and interaction with a child patient offers its own set of challenges and requires a different approach from that of an adult. When dealing the toddler and preschooler, the nurse should visit with the parent first, letting the child size the nurse up. The nurse can assess child on how they interact and react to the parent and the nurse. This allows the child to see that the caregiver has accepted and trusts the nurse. For the toddler and the preschooler, the parent will be providing most, if not all of the health history. When beginning the physical assessment on the child, move slow and approach them slowly while seeming happy and unthreatening. The nurse should allow the child to hold instruments, like a stethoscope, during the physical exam to help them feel like they are involved in their own care. Having parents there add security and support for children, and also can help with the ease of assessing the  child without them realizing that they are being assessed. With children of each stage of development, the nurse must be cognizant of verbal and non-verbal cues provided by the child. The nurse should be mindful that there could be cultural and/or spiritual considerations to take into account, like when undressing a child of the opposite sex. The nurse needs to ensure that the caregiver and the child feel comfortable. With both children and adults, assessment should start with least invasive and progress leaving most invasive last. School-Age children should be assed like either children or adults depending on their developmental age. Adult assessment can be more direct than that of a child. Ask adults open ended questions, listen to their complaints, and educate as needed. References Current Nursing. (2012). Theory of Psychosocial Development: Erik H. Erikson. Choctaw indians :: essays research papers

The Choctaw Indians   Ã‚  Ã‚  Ã‚  Ã‚  The Choctaw Indians is a tribe of Musksgean stock .The Choctaws were once part of a larger tribe that included the Greeks and Seminoles and are considered one of the five civilized tribes (Cherokees , Greeks, Choctaws , Seminoles, and Chickasaws) . At one time Choctaw territory extended from Mississippi to Georgia, but by the time Europeans began to arrive in North America they were primarily in Mississippi and Louisiana.   Ã‚  Ã‚  Ã‚  Ã‚  The Choctaw Indians were into cultivation , they hunted and raised corn along with a host of other crops. One of their chief religious ceremonies was a harvest celebration called , â€Å"The green corn dance.† According to one legend, the Choctaw were created at a sacred mound called Nanih Waiya, near Noxapater ,Mississippi.   Ã‚  Ã‚  Ã‚  Ã‚  In 1540, the Spanish explorer Hernando De Soto led the first European expedition through Choctaw territory. Fighting broke out after the Choctaw refused to supply the Spaniards with a guide and transportation. The Spaniards were in the wrong because the Choctaw Indians were friendly especially with the French and allied with them during the intercolonial wars between France and England . Some Choctaws fought with Jackson at New Orleans against the British.   Ã‚  Ã‚  Ã‚  Ã‚  In 1830, the United States Government passed the Indian removal Act. This act called for Eastern Indians to be moved West to make room for white settlers. The Government then forced the Choctaw to sign the Treaty of Dancing Rabbit Creek. The Treaty exchanged the Tribe’s Eastern land for an area in the Indian territory, in what is now Oklahoma.

Competition in Energy Drinks Essay

1. What are the strategically relevant components of the global and U. S. beverage industry macro-environment? How do the economic characteristics of the alternative beverage segment of the industry differ from that of other beverage categories? Explain. Demographics: The total sale for beverages in 2009 in the US was about 458. 3 billion gallons and it is one of the largest markets with dollar value of 1,581. 7 billion in 2009 and with a forecast of $1,775. 3 billion for 2014. 48. 2 percent of industry sales were from carbonated soft drinks and 29. 2 percent of bottle water industry sales. In 2009, The Alternative beverage industry included sports drinks, flavored or enhanced water and energy drinks made up 4%, 1. 6%, and 1. 2% of industry sales respectively. The global market for alternative beverages in 2009 was $40. 2 billion, while it was $17 billion for alternative beverages in US market. It was $ 12. 7 billion and $9. 1 billion for Asia pacific and European markets respectively. Market growth: The market growth has huge potential with the dollar value of the global market for alternative beverages grew at a 9. 8% annually between 2005 and 2009, but was expected to slow down to 5. 7% annually between 2010 and 2014. US is the country which has strongest growth internationally in term of alternative beverage sales with an annual growth rate of 16. 6% between 2005 and 2009 and a forecasted growth rate of 6. 7% between 2010 and 2014. Europe and Asia-Pacific grew at annual rates of 5. 3% and 5. 6% between 2005 and 2009 and were expected to grow at a rate of 4. 4% and 5. 1% respectively between 2010 and 2014. However poor economic conditions in the US in 2008 and 2009 led to a 12. 3% decline in sports drink sales and a 12. 5% decline in flavored and vitamin waters sales. It was also the reason why energy drinks sales increased only 0. 2% between those years. Rivalry between competitors: Coca Cola, Pepsico and Redbull are the three big players that made the industry rivalry become global. However, there were hundreds of brands like Otsuko which were specialty yet regional brands that did not have a foot print internationally but were doing well in their own terms. Beverage producers had made various attempts at increasing the size of the market for alternative beverages by extending existing product lines and developing altogether new products. Social Forces: * Global beverage companies such as Coca Cola and PepsiCo had relied on such beverages to sustain in volume growth in mature markets where consumers were reducing their consumption of carbonated soft drinks. * Expanding the market for alternatives beverages and increasing sales and market share, beverage producers also were forced to content with criticism from some that energy drinks, energy shots, and relaxation drinks presented health risks for consumers and that some producers’ strategies promoted reckless behavior, the primary concern of most producers of energy drinks, sports drinks, and vitamin-enhanced beverages was how to best improve their competitive standing in the market place. Driving Forces for this industry: * Expanding Market share. * Desire to reach out to Consumer needs and meet the demand * Personalization of the Market Segments * Branding * Market Size * Maximization of Growth Potential General Economic Conditions: * Global growth is projected to grow at 3. 5 percent in 2012, then accelerate somewhat to 3. 6 percent from 2013-2014. In 2012 It is expected that emerging economies will be slow in growth by 0. 7 percentage points on average, going from 6. 3 percent growth in 2011 to 5. 6 percent in 2012, partly as a result of slower export growth and partly because several of them have been growing above trend and the GDP Growth for the world is predicted to be at 3. 6. Things look a little slow but are picking up slowly and there is no recession in sight so far. This could really help the industries like Food, Beverages, Health surge ahead like they already are into the market with more percentage of market share and consumer usage based on the increasing numbers in the trend. Impact of Economic Factors: * Demand on beverages and alternative beverages should remain incremental or stable * Branded alternative beverages with national and international presence should do well * Business opportunities should be encouraged with fair and encouraging interest rates 2. What is competition like in the alternative beverage industry? Which of the five competitive forces is strongest? Which is weakest? What competitive forces seem to have the greatest effect on industry attractiveness and the potential profitability of new entrants? The Beverage industry is highly competitive and the segments that come into picture when it comes to competition are Distribution, Shelf management, Licenses, Brand name and Image, Pricing, Labeling and Packaging, Marketing and Advertising, Quality and taste, Trade and Consumer promotions and Branding. * Competition with non-alcoholic beverages * Competition with Carbonated beverages * Competition with regional beverage producers and private label soft drink suppliers * Competition in maintenance of distribution network * Competition on quality and pricing * Competition on Branding, Labeling, Marketing, Packaging and Promotions. Bargaining power of Buyers: Strong * Convenience store, grocery store, and wholesale buyers had considerable leverage in negotiating pricing and slotting fees with alternative beverage producers because of their bulk purchases. * New entrants with comparatively lower market shares are most affected with this like how it is mentioned in the case where the shelf space is limited to top brands like Coke, PepsiCo and Red bull for that particular market segment. The larger brands like coke and Pepsi also already have spaces worked out with them for their other products and this makes it easier for the bigger brands to get their newer products in the shelf’s too. * Delis and restaurants have low switching costs to other brands but they have less volumes compared to stores and less space, shelfs etc.and also will not have the same bargaining power that a store enjoys. * Demand is highly dynamic Bargaining Power of Suppliers: Weak * Suppliers for alternative beverages do exist in huge numbers and the competition is high * The producers of alternative beverages are important customers of suppliers and buy in large quantities. * Packaging is readily available Threat of Substitutes: Medium * Many substitutes like tea, bottled water, juices, nutrition water etc. have surfaced but the market is not as big as alternative beverages and this customer preference had weakened the competitive power of substitute beverages. * Many substitutes that can quench the thirst of the consumers * Price point of substitutes is less compared to alternative beverages Threat of New entrants: Weak * Brand leaders already exist in the industry with competitive prices and well established distribution system * Convenience stores and Shelves across the stores are already in partnership with existing big-wigs * Customer loyalty towards branded products is high * Need for large financial resources and funds * High Brand equity for already existing and successful brands Threat of Rivalry: Strong. * Competition centers among major brands based on brand image, appealing taste, packaging, R&D, Marketing and Distribution capabilities * Attempts by all the brands to increase the number and types of products in their product line * Low switching costs for the consumers of the industry * Strong marketing campaigns by each brand to gain customer loyalty The Bargaining power of consumers and rivalry that exists between the competitions in this industry contributes to the attractiveness of the industry. The numbers are promising, the industry is dynamic and increase in demand each year. The factors that affect the potential profitability of the new entrants are the Brand image, Distribution network and Product line breadth. 3) How is the market for energy drinks, sports drinks and vitamin-enhanced beverages changing? What are the underlying drivers of change and how might those forces individually or collectively make the industry more or less attractive? * Driving forces of the alternative beverage industry are dependent on the creating/sustaining market demand, dynamics of the growth rate and product innovation. * Industry leaders established: Segments within the alternative beverage industry have consolidated as markets have matured and leaders have been established. Red Bull GmbH and Hansen Natural Corporation remained independent in 2010, Coca-Cola controlled such brands as Powerade sports drink, Fuze vitamin-enhanced beverages, glaceau vitamin water and NOS. In addition, Coca-Cola distributed Hansen’s Monster energy drink in parts of the United States, Canada, and six European countries. * Changes in Long term Growth Rate: The recession had an impact on sales of sports drinks and flavored or enhanced water and has stalled growth in the market for energy drinks; there was also growing market maturity for most categories of alternative beverages. The annual rate of growth for the dollar value of the global market for alternative beverages was forecasted to decline from the 9. 8 percent annual rate occurring between 2005 and 2009 to an anticipated annual rate of 5. 7 percent for 2010 through 2014. While dollar value growth rates were expected to decline only slightly in Europe and Asia-Pacific, the annual rate of growth in the U. S. was projected to decline from 16. 6 percent during 2005 – 2009 to 6. 7 percent between 2010 and 2014 * Product Innovation: The industry is continuing to evolve with introduction of new products that enable rise of new category of products. The recent introduction of energy shots is an example of how an innovation that has given rise to an altogether new sub-segment in the industry. * The creation of new product segments, the increasing positive trends in growth rate and increasing market share for each product are a good indication and good drivers of change that increase the attractiveness of the market for an emergent industry. 4) What does your strategic group map of the energy drink, sports drink, and vitamin-enhanced beverage industry look like? Which strategic groups do you think are in the best positions? The worst positions? The strategic group maps show the industry participants competing with axes of Geographic foot print and Brand. The Map shows that Industry giants like Coke and Pepsico are positioned strongest in the industry due to already existing contracts, supply chain, distribution network and shelf spaces in retail spaces. * Red Bull is seeing a successful brand in Europe and the U. S. * Hansen’s Monster is also doing good standing up to the other market giants with distribution partnership with coke giving it the required space and opportunity to grab the market and hence can be considered at a favorable position. * Rock star has also been at a favorable position due to the same reason of distribution network partnership with PepsiCo * Companies with a single brand and regional distribution like Otsuko, Vitamin water etc. appeared to be at an unfavorable place with chances of competition gulping the market share of the small players very soon. 5) What key factors determine the success of alternative beverage producers? The Key success factors for Alternative Beverage producers are * Constant Product Innovation: A company must be able to identify what a consumer is looking for and also maintain the ability to adapt with the changing market trends. They must be able to keep up and not lag behind. * Price: Price is always a factors in many cases and in this case consumers with a low brand preference will buy a product based on its competitive pricing * Brand Loyalty: Consumers are particular about what brand they purchase and they stick to it in most of the cases. This stresses for a superior brand image and quality * Distribution system: Probably one of the most important, Effective distribution channels will not only help reduce costs but also helps a company remain competitive. * Size and Scale: Successful alternative beverage producers were required to have sufficient sales volumes to keep marketing expenses at an acceptable cost per unit basis. 6) What recommendations would you make to Coca-Cola to improve its competitiveness in the global alternative beverage industry? To PepsiCo? To Red Bull GmbH? Recommendations to Pepsi. * Pepsico have to launch a major image building campaign for the most promising products it has. * Pepsico also needs to develop its own energy shot brand try to convince Rockstar to add an energy shot to its distribution agreement. * In addition, Pepsi should negotiate for distribution rights to European and Asia-Pacific market with Rockstar or launch its energy drink brands in attractive international markets. * PepsiCo can expand its foot print and focus on other international markets in energy drinks for more international presence and to utilize the demand of a branded and standard product. * Red Bull is currently the number in the energy drinks category and they should really take advantage of that and come up with more product line extensions and more products so people can identify with that brand and try other products too. They should focus more on product innovation and product line extensions. Recommendations to Coca Cola * Coca cola should improve its product by innovating and building up good image to recapture the market share it lost in energy drinks category. * Coca cola should also try to create more rapid growth in vitamin-enhanced beverages and energy shots product. * Coke should focus on products and Branding efforts to gain market and regain lost market share in energy drinks * It should build up its strength in term of alternative beverage sales in by pursuing acquisitions and focus on building its strength of sales in Asia and react quickly to solve the problem of lacking competitiveness in the European market for alternative beverages. * Coca cola can use a combination of new flavors and formulations, brands, line extensions, improved image building, and distribution capabilities to increase sales of alternative beverages internationally. Recommendations to Red Bull GmbH * Redbull should improve the performance of its recently introduced energy shots and continue to expand into rapidly growing country markets for energy drinks. * It is necessary for the company to maintain its lead in the U. S. and European energy drink market with additional product line extensions based upon product innovation. * It should develop sports drinks or vitamin-enhanced beverages that can further exploit the appeal of the Red Bull brand 7. Using the data in Ex. 11, 12, 13 compare Pepsi, Coke, and Hansen. Who has been the most profitable? Who has better managed their expenses? Which business has shown the most growth? Which of the three would you give the strongest grade for their performance? * Using the data from Exhibit 11,12 and 13 for Coke, Pepsi and Hansen, Hansen seems to be the most profitable so far as it became the largest seller of energy drink in the US by leading most of alternative beverage categories. PepsiCo’s global market share in 2009 was 26. 5 percent, overcome by 11. 5 percent to Coca-Cola. The Coca Cola has better managed their expenses it was the third-largest seller of alternative beverage and in the top five best-selling non-alcoholic beverages worldwide in 2009. But they have lot of catching up to do. I would give the strongest grade for performance to Hansen for its market share, range of products, product innovation and distribution strategies. Hansen also managed to have higher revenue growth and higher cash flow growth. Net Revenue| 2007| 2008| 2009| CAGR| Pepsi| 39374| 43251| 43232| 3. 17%| Coca Cola| 28857| 31944| 30990| 3. 40%| Hansen| 904465| 1033780| 1143299| 4. 50%| | | | | | | | | | | Net Income| 2007| 2008| 2009| CAGR| Pepsi| 5674| 5166| 5979| 1. 76%| Coca Cola| 5981| 5807| 6824| 4. 49%| Hansen| 149,406| 108032| 208716| 11. 70%| | | | | | | | | | | Operating profit| 2007| 2008| 2009| CAGR| Pepsi| 7182| 6959| 8044| 3. 85%| Coca Cola| 18451| 20570| 19902| 2. 55%| Hansen| 230986| 163591| 337309| 13. 40%| The company growth rate analysis of the three companies in terms of revenue, income and profit show that Hansen has higher percentage of growth rate well above the industry average. Hansen has greater revenues in the industry segment and higher customer demand and financial success.

History: Sociology and Karl Marx Essay

Sociology is the study of people within a society. Three important Modernist Thinkers; Karl Marx, Emile Durkheim, and Max Weber are the three important figures in sociology. During the time of the modernist thinkers, they played a role in sociology thinking. This paper will explore the importance on why these three figures are considered modernist thinkers. What there main focus was and how they are considered a modernist thinker. Karl Marx was born in 1818. He was a German philosopher who believed that material goods are part of the social world. Marx was committed to revolutionist. Marx was trying to influence the social movement. According to Marx, the ideal government would be a communist state where resources are equally shared. Marx was involved in political and social issues which later on lead to more a communist theory. Marx theory on history is focused on whether or not society will rise and fall. Based on this theory Marx was influenced by Hegel. Marx belief on history evolved from many unpredictable directions. Marx was trying to explain the analysis of capitalist within societies and the economic failures that were produced. He suggested different socialist remedies. In the article â€Å"Contribution to the Critique of Hegel’s philosophy of Right† by Karl Marx, â€Å"The foundation of irreligious criticism is: Man makes religion, religion does not make man. Religion is, indeed, the self-consciousness and self-esteem of man who has either not yet won through to himself, or has already lost himself again. But man is no abstract being squatting outside the world. Man is the world of man – state, society† in other words Marx was thinking about how a human being could exist. Religion is dependent on economics such as â€Å" state and society† Marx explained that capitalist takes more of our productive labor where as religion we believe there is a god or to be called that there is a god. Accordi ng to Karl Marx, alienated labor is the process of capitalism. We create dominates us. The difference of alienated labor is â€Å"the relationship of the worker to the product of labour, the second is the relationship of the labour to the act of production, and lastly is the difference is man is a species-being not only in that practically and theoretically he makes both his own and other species into his objects† (15) this is the consequences of man alienation of production from work. Therefore man is opposed from himself. Social change fits with Karl Marx perspective because Karl Marx believed there needed to be a better society and with a social change there was going to be conflict. One of the conflicts was the class conflict, the capitalist. With social change he was able to produce a better society even though there were going to be economic problems. Emile Durkheim was a French sociologist argued that society had to be studied on its own. He was the primary of society. In Durkheim’s perspective society influences individual through norms and social facts. The way an individual think or acts is constituted as a proper domain which is defined as a â€Å"constraint† in Durkheim perspective. â€Å"Constraint† is used to identify the reason behind social facts. A constraint holds power over an individual and becomes stronger over reaction. He believed that societies are held together by values. Durkheim main focus was the concern of social order, how does modern society hold together given the individualism of an individual. In the article Suicide Durkheim connects division of labour and anomie. In Suicide he connects the analysis of suicide, by exploring the different rates, different places and to explain how they are different. Emile Durkheim treats religion by according to the article â€Å"In the Human Meaning of Religion, Durkheim differentiates religion in the context of social life. It states: â€Å"religion is a mirror of society and that in fact what people take to be the realm of the sacred is society itself†(68), in other words religion is a reflection of society. The importance function of religion is to make us act. He states: â€Å"If among certain peoples the ideas of sacredness, the soul and God are to explain sociologically, it should be presumed scientifically that, in principle, the same explanation is valid from all the peoples among whom these same ideas are found with the same characteristics† (68). Based on this article religion is the meaning of life, it provides support and authority figures. Religion impacts and influences society and effects different social norms an individual. Based on my understanding social change does fit with Durkheim perspective. Therefore; in the article Division of Labour in Society, Durkheim focuses on the origin of connecting individual with one another with society, he analysis the social change and explains the conflict in modern society. In Durkheim perspective what unite us is called â€Å"social solidarity† which brings individuals together. In the article it states: â€Å"Society it not seen in the same aspect in the two cases. In the first, what we call society is more or less organized totality of beliefs and sentiments†¦ the society in which we are solidarity in the second instance is system of different, special functions which definite relations unite† (107) meaning solaridity is based on similarity because it binds us together but is different because we are different people. With Durkheim producing social change it was reduced by social reform. Max Weber was a German sociologist. Weber agreed with Marx that individuals had to fight to protect their own property and interest. He also agreed with French sociologist Durkheim; that people interest is determined by shared values. Weber believed in causality. There were multiple causes on why people behave the way they do according to him. He also believed that society is more of rationality and bureaucracy. Sociology should be more of a social action according to Weber. Weber work was the process of rationalization. Rationalization is where rules and laws dominate sectors of society in the model of a bureaucracy. According to Weber â€Å"Class, Status, Party; the way in which social honor is distributed in a community between typical grounds participating in this distribution we may call the ‘social order’. The social order and the economic order are, of course, similarly related to the ‘legal order’ (102), class, status and party was a source of social conflict that became a social difference. Class and status influences one another where as† ‘parties’ live in a house of power† (106) in other words Weber was trying to explain that these spheres are connected by distribution of power. Status makes up the social order and classes are the economic order each promotes power and social change In the article â€Å"Protestant Ethic and the Spirit of Capitalism† focuses on the religions ideas and economic behavior as part of the rationalization of the economic system. It states: â€Å"We can treat ascetic Protestantism as a single whole. But Since that side of English Puritanism which was derived from Calvinism gives the most consistent religious basis for the idea of calling , we shall, following our previous method , place one of its representatives at the center of the discussion†(158).Weber explore the emergency of capitalism was by an ascetic spirit of sacrifice. The development of capitalism was influences by Calvinism. In the society of this time they had more highly capitalist who were Protestants. Social change fits with Weber perspective because in the article Bureaucracy, it states â€Å"The principles of office hierarchy and of levels of graded authority mean a firmly ordered system of super- and subordination in which there is a supervision of lower offices by the higher ones† (89) bureaucracy is a social order where as the authority who changes the order it becomes a social change to society. In conclusion three important figures of sociology were Marx, Durkheim, and Weber. Each three were considered modernist thinkers for sociology. Even though they all had different theories and ideas, Marx believed economics was the force of social change where Weber though religion was. Military Conscription †Argumentative Essay

Military Conscription – Argumentative Essay Free Online Research Papers A rising issue that many people are beginning to notice is the need for more American troops to defend our great nation. Every year, our military has had less and less people volunteer to fight threats to our freedom. Until the World Trade Center attacks, we had a substantial military force, but the number of troops is beginning to dwindle where we need them most. There comes a time when the people of a nation need to rise up and take a stand for this country. Throughout history, the only way sizable forces, forces large enough to win wars, are acquired is through Military Conscription, commonly known in America as the Draft. The Draft is not only useful, but also necessary to win a war, and the time has come to make use of it. Today, in the United States, citizens enjoy the comforts of American society as they go along in their everyday lives. Many people, as they go along their day, tend to forget the sacrifices being made to defend the simple things they enjoy. Others, like me, want to do something about it. Until the war in Iraq and Afghanistan, the Army has had a substantial number of servicemen and women to defend our country. But today, as men are leaving the military, the need for more volunteers rises each day, while the number of volunteers decreases each day. President Bush should have enacted the draft long ago, when the problems with the Middle Eastern people started greatly affecting our economy. But now, with a possible war with North Korea, the draft seems all the more inevitable. We simply do not have the numbers possible to fight two wars at once. George Washington once stated, â€Å"†¦it must be laid down as a primary position and the basis of our system, that every citizen who enjoys the protection of a free Government owes not only a proportion of his property, but even his personal service to the defense of it.† I completely agree with our first President, because I also believe that people have no right to enjoy the freedom of our country without making their own sacrifices for it. The people who protest the draft need only to learn a little history to change their minds. In World War II, we only had six million volunteers to fight. We would not have won that war without the help of over ten million draftees. If somebody wants to complain about the war in Iraq taking so long, they should enlist and help in the effort to end it sooner. It may not matter though, if we end up at war with North Korea, because that will leave three choices for Americans. One: join the military. Two: Enact the draft. Three: Lose the war. I don’t know about everyone else, but I would prefer one of the first two. If enough people do not join the military, than the Government will have no choice but to enact the draft. As thin as the military is already spread out, we have no choice as it is but to have the draft. Believe it or not, the more people we have fighting, the less lives we will lose, and the quicker the wars will end. That is the ultimate goal. Whether voluntary or not, we need more service members. It will be one, or eventually the other. We will soon find our which it will be. History of Scuba Diving and Pioneer Jacques Cousteau

History of Scuba Diving and Pioneer Jacques Cousteau Modern scuba diving gear consists of one or more gas tanks strapped to the divers back, connected to an air hose and an invention called the demand regulator. The demand regulator controls the flow of air so that the air pressure within the divers lungs equals the pressure of the water. Early Diving Gear Ancient swimmers used cut hollow reeds to breathe air, the first rudimentary snorkel used to enhance our abilities underwater. Around 1300, Persian divers were making rudimentary eye goggles from the thinly sliced and polished shells of tortoises. By the 16th century, wooden barrels were used as primitive diving bells, and for the first time divers could travel underwater with more than one breath of air, but not much more than one. More Than One Breath In 1771, British engineer, John Smeaton invented the air pump. A hose was connected between the air pump and the diving barrel, allowing air to be pumped to the diver. In 1772, Frenchmen, Sieur Freminet invented a rebreathing device that recycled the exhaled air from inside of the barrel, this was the first self-contained air device. Freminets invention was a poor one, the inventor died from lack of oxygen after being in his own device for twenty minutes. In 1825, English inventor, William James designed another self-contained breather, a cylindrical iron belt attached to a copper helmet. The belt held about 450 psi of air, enough for a seven-minute dive. In 1876, Englishmen, Henry Fleuss invented a closed circuit, oxygen rebreather. His invention was originally intended to be used in the repair of an iron door of a flooded ships chamber. Fleuss then decided to use his invention for a thirty-foot deep dive underwater. He died from the pure oxygen, which is toxic to humans under pressure. Rigid Diving Suits In 1873, Benoà ®t Rouquayrol and Auguste Denayrouze built a new piece of equipment a rigid diving suit with a safer air supply, however it weighed about 200 pounds. Houdini Suit - 1921 Famous magician and escape artist, Harry Houdini (born Ehrich Weiss in Budapest, Hungary in 1874) was also an inventor. Harry Houdini astonished audiences by escaping from handcuffs, straitjackets, and locked boxes, often doing so underwater. Houdinis invention for a divers suit permitted divers, in case of danger, to quickly divest themselves of the suit while submerged and to safely escape and reach the surface of the water. Jacques Cousteau Emile Gagnan Emile Gagnan and Jacques Cousteau co-invented the modern demand regulator and an improved autonomous diving suit. In 1942, the team redesigned a car regulator and invented a demand regulator that would automatically fresh air when a diver breathed. A year later in 1943, Cousteau and Gagnan began selling the Aqua-Lung.

Conjugation of French Verb Entrer (to Enter)

Conjugation of French Verb Entrer (to Enter) The French verb  entrer means to enter and its a very useful word to know. As you use French in more conversations or travel to French-speaking regions, youll find forms of  entrer  everywhere. Just like with all verbs, when we want to say entered or entering, the verb needs to be conjugated. A short lesson will demonstrate how to do that. Conjugating the French Verb  Entrer Entrer  is not only a very common verb, it also follows a very common verb conjugation pattern. This is a  regular -ER verb  and it shares the same infinitive endings with similar verbs like  enseigner  (to teach),  exister  (to exist), and many others. As with all French verb conjugations, begin by identifying the verb stem:  entr-. We can then add a new ending to match the present, future, or imperfect past tense with the appropriate subject pronoun. For instance, I enter is jentre and we will enter is nous entrerons. The easiest way to memorize all these verb forms is to practice them in context. Luckily, there are plenty of opportunities in everyday life to utilize  entrer. Subject Present Future Imperfect j' entre entrerai entrais tu entres entreras entrais il entre entrera entrait nous entrons entrerons entrions vous entrez entrerez entriez ils entrent entreront entraient The Present Participle of  Entrer The  present participle  of  entrer  is  entrant. Not only is it a verb, you can also use it as an adjective, gerund, or noun in some circumstances. The Past Participle and Passà © Composà © To express the past tense entered, you can use either the imperfect forms or the  passà © composà ©. Forming the latter is quite simple and you might find it the easier option of the two. To construct it, begin by conjugating the  auxiliary verb  Ãƒ ªtre  according to the sentences subject pronoun. Then, add the  past participle  entrà ©. As an example, I entered becomes je suis entrà © and we entered is nous sommes entrà ©. More Simple  Entrer  Conjugations Should you find that the action of entering is subjective or uncertain, use the subjunctive verb mood. Similarly, the conditional verb mood implies that entering will only occur if something else happens. The possibility of needing the passà © simple or the imperfect subjunctive is low. Thats because these are primarily reserved for writing. Yet, knowing them will help your reading comprehension. Subject Subjunctive Conditional Passà © Simple Imperfect Subjunctive j' entre entrerais entrai entrasse tu entres entrerais entras entrasses il entre entrerait entra entrà ¢t nous entrions entrerions entrà ¢mes entrassions vous entriez entreriez entrà ¢tes entrassiez ils entrent entreraient entrà ¨rent entrassent Forming short, direct commands or requests is very easy with the imperative verb form. When using this, the subject pronoun is not required, so tu entre can be entre. Imperative (tu) entre (nous) entrons (vous) entrez

Event Management (Event strategy plan) Essay Example | Topics and Well Written Essays - 1750 words

Event Management (Event strategy plan) - Essay Example People were not happy. This caused severe unrest and people began to revolt. All over the Arab world, including Syria. This revolution has done more damage than good, causing a lot of pain and suffering on the women and children of the country. (Jamoul 2012) This section of society hasn’t even had that much of a role in the uprising. But they have been tortured, abused physically, mentally and sexually, till all hope has been lost. Over 500 children have been killed in a year of the uprising. (United Press International 2012). Women and even young girls have been raped and killed, at the hands of authority – like policemen. (Women under siege Syria 2012) The rest are all miserable and scared, and it is time to do something for them. In an effort to make the lives of the victims of the uprising – especially the women and children, we shall organise a fundraiser on an international scale. An event that will show people just how much the uprising has affected this s ection of society and how badly they are affected. (Peralta 2012) The event will not only be a call for attention but also a cry for action to the privileged so that they can do something for those that have suffered. ... It will have different elements to it such as an auction by international celebrities of their favourite items, followed by live performances. There will be dances, songs, stand up and so on. But the focus of the night will be on the woman and children of Syria who have had to suffer so much. The night will not just be one of fun. It will be emotional. A rollercoaster of a night that will allow people to enjoy their surroundings and a jarring reminder that they have it easy, by showing them what the women and children are going through. We will show them videos and let them see what is happening. These people will be constantly reminded of the sad plight of thousands of innocent women and children who are suffering at the hands of authority. Strategic Aim The whole point of this event is to create awareness among the people of the world, of the plight of the women and children of Syria. That done, we feel it is our duty to aid them in any way we can. They have suffered enough at the hands of authority, and they need to be rescued. By this event, our objectives are threefold. One, to create an international awareness about the plight of the women and children in Syria. Two, to generate funds to aid these victims. And three, to set up trusts that will ensure that the victims are taken care of. All donations will be anonymous. The framework of objectives would need to be broad enough to include the large variety of event genres, but still be lean enough to work with. (Damm 2011). Research Management Events such as these happen all the time. Celebrities and the ‘big shots’ get together to support a cause, have a good time and donate what they wish to a charity of sorts.

Constructivism Constructivism is a learning theory, which says that human beings make out meanings by way of the interaction between their behavioral characteristics and their experiences. This process is known to happen from infancy and hence constructivist approach in learning, puts at the pivotal point, child play. Child play is supposed to be the first step of cognitive development of an individual. Constructivist theory also suggests that there are two processes through which each individual makes meaning out of his/her experiences, namely, acco mmodation and assimilation. Assimilation is the process by which the child or individual absorbs certain new information and incorporates that into the pre-existing meaning structures in his/her mind. The new information just fits into the existing network. But in accommodation, the individual is confronted with a new meaning that is contradictory to his/her existing internal meaning structures. So the individual just reframes those structures so that the new information can be included without contradiction. The basic premise of this theory is the notion, learning by being actively involved in some activity. The constructivist approach demands active learners with care to be taken of the cultural background and individuality and also the role of teachers limited to being facilitators. The most constructivist classroom among the three is the Japanese classroom (Pre-school in Three Cultures). Here, the children are given the freedom to develop into active learners by blending their e xperiences with their own behavioral patterns. This is a major aspect of constructivist approach. The role of the teacher is very limited, again a constructivist theory-based approach. Even when a child misbehaves, he is not disciplined but is left with a choice to learn proper behavior from his fights with other kids (Pre-school in Three Cultures). The teaching method is solely activity based. In the morning, children exercise, then they are given interesting activities like coloring, and origami and during the playtime, they are left on their own to learn how to create friendship and handle difficult situations like a fight. In this manner, a totally free interaction of behavior and experience is facilitated which is the key concept in constructivist approach. By giving activity-based lessons, the children are motivated to find out their own potential. The situation in the school is a perfect balance between formal and informal learning so that there is optimal opportunity for cog nitive learning. The origami lessons are particularly helpful in motivating the children and also make them realize their hidden talent (Pre-school in Three Cultures). Whenever there is a problem for a child in doing an entrusted activity, individual attention is imparted to the child. This is also a practice in coherence with the principles of

Rastafari Research Paper Example | Topics and Well Written Essays - 2500 words

Rastafari - Research Paper Example In this regard, therefore, this research paper seeks to shed some light regarding this group of individuals. Introduction Who are the ‘Rastafari’? Are they some dreadlocked ‘ganja’ smokers to be feared and labelled as criminals? Or are they individuals who sing and dance to the reggae tunes? Based on a letter written to the editor and which featured in Caribbean newspapers in 1982, the author claimed that the ultimate ambition for the ‘Dread’, as they were popularly referred to, is to rip a man’s heart out and feed on his genitals. In Hollywood movies such as ‘Marked for Death’ and television programs, which includes ‘60 minutes’ Rastafarians have been depicted as combative dreadlocked gangsters characterized by red eyes from the smoke of Marijuana. Essentially, an image that one can get from popular opinion is that Rastas are dirty, low-life and drug dealers. They were dreaded in some places, for instance Domini ca that they could be shot at first sight. Some of messages conveyed in their music clearly portray the loath that the society they lived in exhibited against them. For example, Bob Marley, the accredited father of reggae music, sings out that ‘he shot the sheriff for self-defense.’ Similarly, in his hit song ‘Redemption song’, he expresses his agitation in the manner that the prophets of Haile Selassie are murdered by the bullet of the gun. Nonetheless, an encounter and research on these individuals gives a totally different picture about them as discussed in the subsequent sections. Rastafarian first came into being in the 1930 in Jamaica and it’s perceived to represent some spiritual ideology. However, a significant proportion of its adherents argue that it is more of â€Å"a way of life† rather than a religion. The adherents hold Haile Selassie I, an emperor of Ethiopia who reigned between 1930 and 1974, as God the Father while others as J esus. Those who subscribe to the teachings of Emperor Haile Selassie are referred to as Rastafari or simply Rastas. As such, Rastafarianism thus describes their way of life although some Rastas consider it as derogatory. This could be explained by their dislike and bias against â€Å"isms†, which is generally a part of typical Babylonian culture. The name Rastafari is believed to have been formed by a combination of two words, Ras and Tafari. Ras is s title given to a â€Å"head† or rather â€Å"leader†. This according to the translation of ras from Amharic, a local dialect group based in Ethiopia. On the other hand, Tafari is the first name of Tafari Makonnen, who is the famously known as Haile Sellasie I. The adoption of the new name followed his coronation. However, there is some discrepancy from Murell who argues out that Ras means Christ; while Rastafari refers to Haile Selassie, the founder of the movement (Murrell 4). Rastafarians claim that Haile Selassi e is their Christ who died physically, but lives in their souls. The believers argue that Christ shall come back to save them from the world, and he shall take them to Ethiopia. The followers argue that Ethiopia is the land that Christ promised them, and they refer to it as Mount Zion. Doctrines Hardly will one interact with a Rastafarian without getting to hear the mention of the term â€Å"Jah†, which, as is mostly the case, a precursor to the utterance of Rastafari. Generally,

This is despite the fact the colleague had paid for medical cover in the University. Thus, the failure of the University to meet such basic costs underlines the undependable nature of the medical cover. At this instance, we pause and ask the question of what would have been the consequence of us not raising money for the ambulance. This can only m ean that the investable would have happened. Crisis Management Communication Case Study Example | Topics and Well Written Essays - 2500 words

Crisis Management Communication - Case Study Example Timothy Coombs developed a three-phase situational crisis communication theory that has been adopted by organizations to handle the crisis. According to this model, communication during a crisis takes three steps which include the pre-crisis communication approach, crisis management communication and post crisis approaches. In 2010, British Petroleum (BP) experienced one of the major crisis to affect the company when one of its offshore drilling sites leaked, leading to a major spill in the gulf of Mexico. This spillage led to the loss of 11 lives and the loss of millions of gallons of crude oil from the drilling reservoir (Coombs & Holladay, 2001). The spillage affected the reputation of the company as it was exposed to major media scrutiny as their mitigation approaches were under scrutiny. However, with the help of the United States government, the oil spill was contained and the company compensated those who lost their lives in the crisis. In this paper, Coombs situational communication model during the crisis will be used to evaluate the approaches that were adopted during the crisis. The organization’s ability to prepare for the crisis and address the concerns during the crisis will be addressed. At the end of the crisis, the company was left with a tainted image from massive media scrutiny making post-crisis communication approaches essential to determine how the company regained its image (Wolf & Merji, 2013). Pre-crisis communication is an anticipatory approach adopted by organizations to prepare for how to handle the pressures of a crisis and how the crisis may expose them in a bad light. During this phase, early signs of a crisis are evaluated and the company makes frantic efforts to address them and ensure that any challenges that may arise are addressed promptly. Before the BP oil crisis, a breach of cement seals at the bottoms of the wells was noted.

5 great leadership qualities Essay Example for Free

5 great leadership qualities Essay Leaders are often portrayed as heroes and role models, but there is also a darker side to being a leader. Adolph Hitler was one of the greatest leaders in the last 100 years, if not the greatest leader of all time. One man had the ability to lead a country, with a population of 20 million people, against the whole world in a vision he saw fit. One man leading Germany out of economic depression after previously being through World War I was an incredible feat. This is indeed what all leaders strive to be. Hitler is one of the best models for inspiring leaders. He exhibited some of the greatest qualities of being a leader, which included the following: vision, eloquence, charisma, strong will, and tyranny. Vision is a manner in which someone conceives something. All leaders must be goal oriented, and Hitler had one of the greatest objectives of all time. He wanted to purge this world of all the Jews, Gypsies, Homosexuals, and anyone else that didnt fit in his definition of the perfect race. His perfect race the Arian race consisted of blonde-haired, blue-eyed Caucasians. Although he was not able to complete his vision, he still fought for it until the end of his life. One of the most outstanding leadership qualities of Hitler was his eloquence. Being eloquent is to be fluent and persuasive in speech. Hitler would stir up the masses with his fervent speeches. This was one of Hitlers greatest assets. He was able to get his audience so passionate and zealous over his goals, that they would follow him regardless of what he said. Imagine in what manner someone must talk with 20 million people in order to persuade them to eradicate a race without moral regret. When he would speak, he would sweat and get so fanatical about his speech that women would cry when he spoke. Another important quality of Adolph Hitler was his charisma. Charisma is a quality attributed to those with an exceptional ability to secure the devotion of a large number of people. Without charisma, a leader can not function successfully. Hitler attained devotion from almost anyone that he spoke to. The German people were ready to fight the rest of the world to achieve the world that Adolph Hitler saw fit. Men were willing to give their  lives to satisfy a single man. Hitler had one of the strongest wills of any man that this world had seen. He refused to allow anyone get in his way. This is what led to World War II. He would even betray the Russians, his one time allies, for not also agreeing with his ideas. His will also helped Germany out of depression. It is said that Germany had the greatest economy it has ever had in the rule of Adolph Hitler. He did this by political maneuvering and strategic planning. His will helped make Germany one of the most powerful countries in the world in its time. In fact, some historians devote the end of the depression due to Adolph Hitler. This is because many governments got out of their economic depression by actually fighting in World War II. This stimulated many countries and helped the world all over. The last of his important qualities was tyranny. A tyrannical government is one in which there is a ruler with absolute power. Tyranny enhanced all of his other traits. This is because if someone did not follow him willingly, they were forced to follow him under his government. A leader demanding absolute power is not a bad thing at all times. It does not allow for confusion within a group and may also lead to more efficiency and cooperation. Hitlers tyranny united Germany under one person and allowed it to challenge anyone that stood in their path. Adolph Hitler may not have been a great person, but he was a great leader. Under his rule, Germany pulled out of an economic depression that was plaguing the rest of the world. Also, Germany stood up once again after a First World War and challenged the world once more. Many people might disagree about him being a great leader because he led Germany to another loss, but this was inevitable because one man cannot stand against the world and hope to win. Nevertheless, Hitler was one of the greatest leaders of all time and should be a template for future leaders.

Existentialism in The Trial by Kafka

Existentialism in The Trial by Kafka The Czech writer FRANZ KAFKA (1883-1924) belonged to a middle class family. His father Herman was disrespectful and ill tempered towards Kafkas escape into the literature work and writing. Kafka became the eldest and only son when his two brothers died and he was aware his role in the family and rest of the life. Franz Kafka is one of the greatest influences on Western literature in the twentieth century. He has inspired a whole range of artists from the creators of the detective story to writers of the television series Twilight Zone. He began work on The Trial in 1914 after a horrendous encounter with his fiancà ©, Felice Bauer, her sister, Erna Bauer, and Grete Bloch (a short-term lover). According to Kafkas friend Max Brod, he never finished the work and gave the manuscript to Brod in 1920. After his death, Brod edited The Trial into what he felt was a coherent novel and had it published, despite the German ban on Jewish literature, in 1925. The manuscript eventually passed from Brods heirs to the German national literary archives in the late 1980s for several million dollars. Since then, new editions have been published and some textual integrity re stored to the English version of the story. He was isolated and subjected to unknown terrifying forces. KAFKA has narrated many stories and novels in his writing. In his novel The Trial he tells the story of a country doctor who goes to check a sick child. When he reaches the sick child home he discovers that child has been consumed by the maggots. In his same novel The Trial, KAFKA relates a story about a man known as Joseph K who has awakened at one night by hammering on his door. He finds that he was under arrest. The Trial in 1926 is his novel with the style of meditations, parable, poetic fragments and sketches. His work is open due to multiple interpretations and difficult categories and reflects the existentialism and modernism. Existentialism is a vast and meticulous philosophy that, in a nutshell, advocates a diverse arsenal of responses and solutions to the existentialist attitude which, essentially, is what an individual feels when confronted by the absurdity of life. Throughout humanity, ruminations and self-proclaimed ultimate truths have assumed various forms: prose, poetry, religion and numerous other doctrines, to name but a few. Kafka has inspired many of the great novelists of the twentieth century. Consequently, there is an incredible amount of literary criticism devoted to his work. The critical material discussing The Trial falls between two poles. On the one hand, Kafka is viewed through a psychological or religious lens that sees the tensions of his work as derived from an oedipal complex or the heritage of the Judaic law. At the other extreme, where few tread, are the positivist approaches of Walter Benjamin, Gilles Deleuze, and Felix Guattari. This latter approach finds a new philosophy, a new politics, in Kafka that is as yet unexplored. Whatever the approach, there is general agreement that Kafka should be praised for his deft depiction of twentieth-century alienation and bureaucracy at the universal level. K., except for a brief friendship with Hasterer, prefers his own company. In the matter of his trial, he didnt want to enlist anyones aid and thus initiate them in the matter even distantly. To do so would be to initiate another person into himself. This is an act he cannot even do in the form of a petition. This is as it should be since the trial is his own, it is his guilt, and no matter what he does or where he goes, that is where the inquiry will be located: he is certainly being treated with strange carelessness. As much as K. desires it, he is not alone. Everyone who knows him also knows about his trial. From his point of view, the entire universe finds him guilty from the casual observer to the men who kill him like a dog. In Kafkas view, there is a way of life for any individual that is the right one, and which is divinely sanctioned. So much is perhaps admitted by most of our moral novelists; but to Kafka this fact itself constitutes a problem of tremendous difficulty, because he believes the dichotomy between the divine and the human, the religious and the ethical, to be absolute. Thus, though it is imperative for us to attempt to follow the true way, it is impossible for us to succeed in doing so. This is the fundamental dilemma that Kafka believes to lie at the basis of all human effort Conclusion Kafka employs the fictional literary elements he constructs to address the very non-fictional, existentialist aspects of society and life. Akin to Dostoyevskys Notes from Underground, it can be interpreted as both a rumination and tirade against impersonal communities, restriction of freedom, and the absurdity of life. It would be foolish to expect that an examination of Kierkegaards argument that religious faith is totally divorced from reason, and of Kafkas private response to it, would lead to a firm conclusion for or against Kierkegaards position. Kierkegaards book assumes that his readers come to it equipped with an attitude of religious belief. Without that, his poetic flourishes would be less effective, and his dialectical proofs would lose force.

Learning How to Read Essay -- Cognitive Process, Childhood, Reading

Learning to read is a complex cognitive process which progresses throughout childhood. In order to develop good reading and written skills, an individual requires both orthographic knowledge and phonological awareness (Waldie et al., 2013). Orthographic knowledge is the ability to use information stored in memory to represent spoken language in written form. On the other hand, phonological awareness refers to the ability to detect and understand sound structure and phonemes (the smallest units of distinct sound in a specific language). Models of reading such as the parallel distributed processing (PDP) models suggest that both orthographic and phonological systems work together to activate lexical semantics (Waldie et al., 2013). Some children have great difficulty in learning to read, and if this problem persists, may be assessed to identify whether or not they have a learning disability, such as dyslexia. In this essay a brief definition of dyslexia will be given followed by a shor t introduction of early research that points towards a biological basis for dyslexia. Specific neural pathways and brain regions will then be identified and findings discussed in relation to specific topographical areas of the brain investigated in dyslexics. There are many different definitions of dyslexia, but most studies characterize dyslexia as a neurobiological disorder resulting in reading impairment despite the intellectual aptitude, sociocultural opportunities, and motivation to read with accuracy and fluency (Lyon et al., 2003). It can also be characterised by difficulties in spelling, working memory and decoding abilities. Furthermore, dyslexia can be broadly categorised into two main types: developmental or acquired, although there are num... ...f Neurology, 7(1), pp. 35 - 46. Good Country People

In the short story â€Å"Good Country People,† Flannery O’Connor utilizes the characters Joy Hopewell and Manley Pointer to expose how believing in nothing makes a person isolated and spiritually empty. Joy Hopewell is a well-educated, thirty-two year old atheist with an artificial leg. Joy's lack of belief causes her to lose all the human civility and decency she has. She even changes her name to Hulga. Flannery O'Connor's use of the mythological Trickster persona to seek, attract, and repulse the protagonist Joy-Hulga leads to her spiritual enlightenment. Manley Pointer through the Trickster persona seeks out the Hopewells, specifically Hulga. From the beginning the Bible salesman uses the svelte and persuasive words used by the Trickster. Pointer maneuvers himself inside when he tells Mrs. Hopewell, â€Å"Lady, I’ve come to speak of serious things. † He continues, using her own thoughts and feelings to manipulate her, telling her, â€Å"I know you belie ve in Chrustian service† and â€Å"People like you don’t like to fool with country people like me. † The Trickster knows that Mrs. Hopewell is just being polite, but he persists, taking advantage of her desire to avoid all conflict and her love of â€Å"good country people. † Manley craftily gets himself invited to dinner out of sympathy.Knowing that Joy-Hulga has a heart condition, the Trickster deceives Mrs. Hopewell by telling her, â€Å"I got this heart condition. I may not live long. When you know it’s something wrong with you and you may not live long, well then, lady†¦Ã¢â‚¬ Through deceit and smooth talking, Pointer guarantees he'll spend the evening at the Hopewell's home. The Trickster has found his way inside and can now focus on his target Hulga. The Trickster has found his target and continues to use his mythological persona to attract Joy/Hulga. Pointer uses his silver tongue to convince disagreeable Hulga to accompany him on a picnic the next day.The con-artist tells Hulga, â€Å"I think you're brave. I think you're real sweet† and then later asks her, â€Å"Don’t you think some people was meant to meet on account of what all they got in common and all? Like they both think serious thoughts and all? † Manley is establishing a connection between Hulga and himself to make himself seem more attractive. Manley Pointer further personifies the mythological Trickster persona when he shows up the next day for their picnic in a broad-rimmed hat, and he's also described as very tall, â€Å"Then suddenly he stood up, very tall, from behind a bush on the opposite embankment.Smiling, he lifted his hat which was new and wide-brimmed. † These are two physical traits of the mythological Trickster persona. As they reach the barn, Pointer tricks Hulga and baits her into climbing up to the second floor where the climax of the story occurs. The Trickster fools Hulga by acting innocently as he â₠¬Å"pointed up the ladder that led into the loft and said, ‘It’s too bad we can’t go up there,'† implying that she can't do it because of her handicap, so she quickly proves him wrong.Hulga's pride and feeling of superior intellect blind her from seeing that she's being duped by the Trickster. Flannery O'Connor uses the Trickster persona to repulse the protagonist bringing her to spiritual enlightenment. After Manley Pointer lures Hulga up into the loft of the barn, he becomes more demanding, using Hulga's feelings for him to manipulate her into giving him what he wants, he says, â€Å"'I known it,' he muttered, sitting up. ‘You're just playing me for a sucker. † The Trickster starts to show his true character more and more now that he has Hulga where he wants her. Manley manipulates Hulga into giving him her fake leg which symbolizes Hulga/Joy's soul. As the Trickster takes Hulga's leg, he starts to bring her back into the light and give her a new start. You see it happening when Hulga says, â€Å"When after a minute, she said in a hoarse high voice, ‘All right,' it was like surrendering to him completely. It was like losing her own life and finding it again , miraculously, in his. † Pointer takes Hulga's leg and leaves her there stranded in the loft to ponder her new spiritual enlightenment. Flannery O'Connor uses the Trickster persona to seek, attract, and repulse the protagonist, thus bringing her new enlightenment on her life. Hulga/Joy had lost all human civility and decency in her life using her intellect as an excuse. As Hulga sits in the loft, she is finally forced to realize the error in her ways.

Great Expectations Essay

Magwitch is simply portrayed as an evil man chasing a little boy while in the Lean version we get to learn a little more about Magwitch and can empathise with him more. The 1946 Lean version incorporates both characterisation and maintaining the audience’s interest (done through dialogue rather than just one dramatic word). Therefore, I would argue it is more effective. The sound effects used in both films are dramatic and each has moments where the sounds used are more effective than the other film. For example, Lean’s film makes use of trees creaking, wind whistling, a short sharp scream and loud lonely bird calls. These sounds build up the effect of loneliness and solitude surrounding Pip. This is effective because it allows the audience to become emotionally attached to the character which makes it more dramatic when Pip meets Magwitch. On the other hand, the 1999 version of the film makes use of heavy breathing and very loud sudden bird calls. These sound effects are mote dramatic than the other film’s effects because the birds and heavy breathing are very loud and upfront rather than subtle. They really add to the scene and so I believe both the films have equally effective sound effects. A heavy use of symbolism is evident in both films. In the Lean version some symbolism used includes the book at the beginning. This represents that a story is about to be retold and the pages of the book turning suggest that the audience are being immersed into a story. The book may also be a subtle tribute to Dickens from Lean who acknowledges that the film is based on a novel. In fact, Lean tries to remain faithful to some of Dickens’ descriptions such as the horizontal lines in the sky. The shot of Magwitch’s dirty skin is also an interesting use of symbolism. This is very effective because not only does it introduce us to Magwitch’s circumstances but it also helps develop an alternate side to him. The dirt on his skin not only suggests that he is different underneath but also shows that he has been through a lot. The contrast in colouring between Magwitch’s dark hand and Pip’s pale skin also reiterates how Magwitch is more evil and Pip is vulnerable. It is very effective because it has many purposes and is done very subtly. There is also symbolism in the later film and an interesting example is the birds flying in the sky. The quick transition from Pip’s face to the flying birds suggests to the audience that something terrible is happening. The timing of the cut suggests that the birds’ caws are covering what would be the boy’s screams. There is also the symbolism in that birds are free and can fly away from trouble while Pip is limited and can not get away so easily. I would argue that there is more important symbolism that has more purposes in the Lean version because there is a tribute to Dickens and it is used to develop the characters and plotline while the later film mainly uses symbolism for dramatic effect only. One way in which the earlier version is very good is in the use of the camera. One place where it is very effective is when there is a long shot panning behind a tree in a graveyard it is possibly a point of view shot. This not only sets the scene and establishes the background due to the long-shot but also creates the feeling that the audience are hiding and watching the boy. This makes them wonder what will happen to the boy as the audience will not know at this moment whether the character whose view we are taking has good or bad intentions. There is editing where there is flicking from one shot to another and this builds tension and creates confusion. This is used in the dialogue between Pip and Magwitch to show the urgency of the situation. Between this rapid editing the shots are mainly extreme close ups of Magwitch’s face to create fear and close-ups of Pip so his emotions are very clear to the audience. The 1946 film has a lot of variations in shot however; the 1999 film mainly uses point of view and mid-shots which are interesting because they allow the audience to stay close to what is going on. Yet the variety in the Lean film keeps the audience’s interest engaged. There would not have been a choice at the time the film was made but because the film is in black and white it is often very striking as the black white and grey seem minimalist but they still strongly contrast. Lean uses the black and white to create stark contrasts in the sky and background to emphasise the eeriness and loneliness of the setting. So although he can not make full use of the colour that the later film can Lean uses the contrasts in symbolism. Overall, I would say that although both films have very good openings the earlier one has more ways that make it a better introduction to the story as a whole. Generally I feel that the Lean film has shots that allow for more characterisation and development of plot while also making the vital dramatic impact that is imperative to retain the interest of an audience. Society in the USA Essay Example | Topics and Well Written Essays - 1750 words

Society in the USA - Essay Example But in as much as I don't want to make a drastic change, I have to awaken them in the reality that I have to move. We have to move forward. The kids are growing. They will not be forever children. College is so expensive. Betty Friedan's "Feminine Mystique" has reawakened me and my feminine will for power, but also to save my family from poverty and deprivation. The woman has equal rights and responsibilities as the man. She is there to help, not to be a slave to her husband. Her diploma and the years she spent to earn it must not be a mere decoration, to be forgotten by the passing of time. She must leave a mark for herself and her family who equally needs her support and guidance. I can not forever stay idle at home and see this growing family go hungry, or depend entirely on a salesman's income. There are times I have to find ways to make ends meet, when my husband is not able to meet his quota. We have to work together, hand in hand we can fight poverty. If there are opportunities of a job for a housewife like me, I can start. I can start a small business, even if I stay at home. I have wonderful ideas inside me that can turn little things into income. My husband must not be forever a slave to his chauvinistic mind that he is superior, above every woman, or that his decision and ideas will prevail. This is America, forever free for everyone, including a woman. To mTo my daughter: be strong, finish college, and don't be just a subordinate to your husband. Being a woman does not mean staying at home after college. Responsibility at home must be shared between a husband and wife. And this must be talked about. An open dialogue, an open communication between the couple is a good beginning. Shared responsibility leads to progress in the family. Mutual understanding and goal setting are co-equal, just as the wife is co-equal with her husband. The man is the head of the family but the woman must not be left behind. His decision is also a shared decision, co-equal with hers. To my son: be a good example. Follow your father's footsteps, if you want to. But set your goals, and don't leave the woman behind. She is as human as you are. Respect her just as you respect me. Build a home, secure your family - with a woman who will not be a slave at home, but who will go with you to be strong builders of a home and nation. A nation's economy is also the responsibility of people and families. 2. Dr. Laura Schlessinger and her "New Traditionalism" Dr. Laura Schlessinger's books, ideas and philosophies simply tell us something: go back to the basics. This is what she has been telling the world in her "new traditionalism" concept of inter-personal relationships, in the home and family, caring for children and husbands. In fact, she says, "women have the power to control the quality of their lives with their men" and that is taking good care of them, and not just nag and nag them, and be "workhorses" that they are now, forgetting their role inside the home. The traditional way of caring is the husband goes to his job, while the wife stays at home, taking care of the kitchen and the children. Dr. Laura teaches a new approach by not really going back to the old times of the wife staying at home and the

This paper aims to; critically discuss the case of State of Nebraska v Jerry Watson in its entirety and, the importance of fingerprints/latent to the conviction of Jerry Watson. In an apartment in Omaha, Nebraska, Bonnet, the victim was living alone. After failing to report for work for two days in a row on October 17, 1978, a friend called the manager to check on him in his apartment complex. The manager of the complex looked through the mail slot in the door and saw him lying inside, he then knocked the door. When he failed to answer his door, through the mail slot, he saw Bonnet lying there but, he looked injured or very sick. The manager then decided to call an ambulance to rush Bonnet to the hospital for treatment. The Fire Department of Omaha responded to the call for help. Forcibly, they entered the apartment after the initial futile attempt to gain access to the apartment. Bonnet was found lying head facing down and naked. In his abdomen, he suffered one wound. The stabbed wound seemed to be the cause of his death as revealed by an autopsy. The Omaha police then began to process the complex apartment as the crime scene after securing it and discovering Bonnets body. Before the crime, the apartment was described as neat and very orderly. Photographs of the scene and evidence from the apartment taken by the crime scene investigators became part of the evidence. Newspapers were found scattered both on the floor and on a coffee table, and the telephone cord found severed. Hair and fecal matter found in the three towels found near Bonnets body. Cans of beer found in the kitchen sink and the trash can. A note that stated a piece of evidence also left the scene of the crime. The note ends with a derogatory statement to the police officers. After a thorough search, Bonnets wallet or any cash could
